These assets are provided for your use as an active client of DotCom Global Media and do not transfer upon termination of services.

If specific graphics were paid for by you (the client), as indicated by a separate paid invoice, the client may retain those graphics. Under no circumstances may any DotCom graphics or creative work products be used apart from DotCom’s services without expressed written consent from DotCom.

Purpose and Applicability

1. Ownership Rights

DotCom retains exclusive ownership of the following assets:

1. Fence illustrations, graphics, and animations
2. Original creative design elements

2. Usage Restrictions

Upon termination or discontinuation of DotCom’s digital marketing services, the Client:

1. - Shall not use, copy, distribute, or reproduce DotCom’s assets for any purpose, including without limitation, new websites, social media, print materials, or branded products.
2. - Agrees that any unauthorized use of these assets will constitute a breach of this Agreement and may result in legal action.

3. Ownership of Commissioned Works

1. Only those graphics or creative works specially commissioned and fully paid for by the Client shall be transferred to the Client.
2. These works will be distinctly invoiced, separate from the recurring monthly service fees.

4. Enforcement and Remedies

DotCom has the right to seek a court order to immediately stop such use of assets (injunctive relief) without authorization, as the unauthorized use of these assets could cause significant, non-monetary harm to DotCom’s business and reputation.

1. The Client consents to injunctive relief in the event of unauthorized use of DotCom’s assets, acknowledging that monetary damages may be insufficient to cover potential harm.
2. The Client agrees to reimburse DotCom for any costs, including legal fees, incurred in enforcing this Agreement.

5. Acknowledgment and Acceptance

1. By signing, the Client acknowledges understanding and acceptance of the terms herein.
2. The Client is aware that only separate billing statements indicating payment for specific custom work confirm their ownership.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Florida. The parties consent to the exclusive jurisdiction of the courts in Collier County, Florida, for any disputes arising from this Agreement.
